[icon_timeline][icon_timeline_item time_title="1. ENTIRE AGREEMENT"]This agreement contains the entire understanding between Dewwond Mapp Photography and THE CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to change or add to this agreement is to do so in writing, and provide the document is signed by all the relevant parties.[/icon_timeline_item][icon_timeline_item time_title="2. CLIENT"]Affirms that CLIENT is at least 18 years old and has the capacity to enter into a contract with Dewwond Mapp Photography.[/icon_timeline_item][icon_timeline_item time_title="3. RESERVATION"]Upon your signature, Dewwond Mapp Photography will reserve the time and date agreed upon, and will not make other reservations for that time and date. For this reason, the Reservation Deposit of 1/3 of the Total Fee is non-refundable, even if the date is changed or the wedding is canceled for any reason, including acts of God, fire, strike, and/or extreme weather. The Reservation Deposit is to be paid at the time of signing the contract. The Reservation Deposit is applied towards the contracted wedding photography package. THE CLIENT understands and agrees that the entire amount owed for the wedding photography package described in the contract is due at least one week before the wedding date.[/icon_timeline_item][icon_timeline_item time_title="4. FINAL IMAGERY DELIVERY"]After the wedding, Dewwond Mapp Photography will provide THE CLIENT with a private password-protected gallery that will display all images previously agreed upon. The online gallery will allow you to download, share, and order prints. THE CLIENT should expect completion of their photos no sooner than 6 weeks after the event date.[/icon_timeline_item][icon_timeline_item time_title="5. CANCELLATION"]In the event that THE CLIENT cancels the wedding photography services outlined in this contract before the wedding ceremony takes place, THE CLIENT agrees to pay Dewwond Mapp Photography liquidated damages equivalent to the Reservation Deposit. Dewwond Mapp Photography agrees to refund all additional paid money if any, (fewer expenditures for which receipts will be provided) to THE CLIENT. If the client is due a percentage refund, please allow 10-14 days for the reimbursement. Dewwond Mapp Photography, in association with Kentyla Arts Designs is a small local media company, and may not have large amounts of funds available to immediately refund.[/icon_timeline_item][icon_timeline_item time_title="6. PRE-EVENT CONSULTATION"]It is strongly recommended that THE CLIENT schedule a pre-event consultation prior to one month before the wedding date to finalize the actual shooting times and locations.[/icon_timeline_item][icon_timeline_item time_title="7. EVENT GUIDE"]THE CLIENT will be responsible for designating an “EVENT GUIDE.” The role of the EVENT GUIDE is to identify people/objects of whom/which specific photographs are desired, as well as to make certain that these subjects are available when needed. It is recommended that THE CLIENT develop a list of desired poses, locations, and subjects (family and friends) and share this with the EVENT GUIDE well before the wedding. The photographer will NOT be held accountable for not photographing desired people if there is no one to assist in identifying or gathering people for the photograph(s).[/icon_timeline_item][icon_timeline_item time_title="8. COOPERATION"]The parties agree to positive cooperation and communication for the best possible result within the definition of this assignment. Dewwond Mapp Photography is not responsible for key individuals’ failure to be present or to cooperate during photography sessions, nor for missed images due to details not revealed to Dewwond Mapp Photography. Dewwond Mapp Photography recommends that THE CLIENT designate an "event guide" (see PRE-EVENT CONSULTATION above) to point out important individuals to the photographer, whom THE CLIENT wishes to include in informal or candid photographs.[/icon_timeline_item][icon_timeline_item time_title="9. HOUSE RULES"]The photographer is limited by the guidelines of the ceremony officiate or the reception site management. THE CLIENT agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is THE CLIENT'S responsibility; Dewwond Mapp Photography will offer technical recommendations only.[/icon_timeline_item][icon_timeline_item time_title="10. DIGITAL NEGATIVES, PRINTS, & COPYRIGHTS"]The photographs, digital negatives, or prints produced by Dewwond Mapp Photography are protected by U.S. Copyright Law (all rights reserved) and may not be reproduced in any manner without Dewwond Mapp Photography’s explicit written permission. THE CLIENT will receive a personal-use printing release to print the images outlined in the above agreement.[/icon_timeline_item][icon_timeline_item time_title="11. MODEL RELEASE"]THE CLIENT hereby assigns and grants Dewwond Mapp Photography and its legal representatives the irrevocable and unrestricted right to use and publish photographs of THE CLIENT or in which THE CLIENT may be included, for editorial, trade, advertising, or any other purpose and in any manner and medium; to alter the same without restriction and to copyright the same. THE CLIENT hereby releases Dewwond Mapp Photography and its legal representatives and assigns from all claims and liability relating to said photographs. It is agreed that Dewwond Mapp Photography may display and use the photographs taken for advertising, display, website and internet promotion, photographic contests, public display such as in malls, photography books, photography instructional books, storefronts, window displays, studio display, television advertising, magazine advertising, and any other purpose thought proper by Dewwond Mapp Photography.[/icon_timeline_item][icon_timeline_item time_title="12. EXCLUSIVITY / GUEST PHOTOGRAPHY"]It is understood that Dewwond Mapp Photography will act as the sole and exclusive wedding photographer. Dewwond Mapp Photography reserves the right to bring one assistant at their discretion. Since flashes from guests’ cameras may ruin shots taken by Dewwond Mapp Photography, THE CLIENT acknowledges that they are responsible for notifying all of their guests that guest photography is not permitted at any time while the professional photographer is in session. The formal photography time is for the exclusive use of Dewwond Mapp Photography to capture formal wedding portraits. Due to time constraints and the need for subjects to pay full attention to the professional photographer, guest photography is requested to be done at a separate time.[/icon_timeline_item][icon_timeline_item time_title="13. COMPLETION SCHEDULE"]Digital processing takes approximately six weeks. Creation of a wedding album takes an additional four to six weeks, enlargements one to two additional weeks, or possibly longer when laboratory and bindery schedules are heavy.[/icon_timeline_item][icon_timeline_item time_title="14. PAYMENTS"]THE CLIENT agrees that a 1/3 reservation deposit is required at the time of contract acceptance and 100% of the remaining balance is due at least one week before THE CLIENTS’ wedding date.[/icon_timeline_item][icon_timeline_item time_title="15. FINAL IMAGE DELIVERY"]Dewwond Mapp Photography will send THE CLIENT a link via email to their final images hosted on an online gallery. It is the responsibility of the client to download their own images.[/icon_timeline_item][icon_timeline_item time_title="16. METHOD OF PAYMENT"]Payment may be made by

B.) Zelle.[/icon_timeline_item][icon_timeline_item time_title="17. LIMIT OF LIABILITY"]Dewwond Mapp Photography warrants and declares that every effort will be made to provide high-quality photographic services. In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative photographer. Dewwond Mapp Photography will make every effort to secure a replacement photographer who is able and/or willing to provide a similar package as chosen in this contract at the same/similar tariff. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. Dewwond Mapp Photography takes the utmost care with respect to exposure, transportation, and processing of photographs; including using professional-grade equipment and professional-grade backup equipment. However, in the unlikely event of THE CLIENT’S photographs being lost, stolen, or destroyed for reasons within or beyond Dewwond Mapp Photography’s control, the latter’s liability is limited to the return of all payments received for the event package. This limitation of liability shall also apply in the event that photographic materials are damaged, lost through camera malfunction, compact flash card malfunction, or otherwise lost or damaged without the fault on the part of the Photographer. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of the total number of originals.[/icon_timeline_item][icon_timeline_item time_title="18. NON-GUARANTEE"]Although every possible care will be taken to produce photographs of all important and special events during the wedding, Dewwond Mapp Photography cannot place an unconditional guarantee on the above. Dewwond Mapp Photography will not be held responsible for any ruined photographs due to guests’ (or any other) flashes; or any other ruined photographs due to any other cause in or outside of Dewwond Mapp Photography’s control.[/icon_timeline_item][icon_timeline_item time_title="19. COVID-19 CLAUSE"]Dewwond Mapp Photography understands that this is a very trying time for everyone, globally. Please have a look at my Force Majeure and Safe Environment Clause.[/icon_timeline_item][icon_timeline_sep time_sep_title="Detrimental Mentions"][icon_timeline_item time_title="X.1"]If Dewwond Mapp Photography cannot perform or believes he may not be able to perform this Agreement in whole or in part due to a fire, natural disaster, act of war or terrorism (domestic or foreign), epidemic, or pandemic
(including COVID-19), action of any governmental authority (including a Government Order as defined in Section 7.3), national or regional emergency, other casualties, an act of God, or other cause beyond the control of the parties or due to Photographer’s illness or injury, whether or not foreseeable (“Force Majeure Event”), then Photographer will give notice to the Client as soon as reasonably practicable after Photographer determines that a Force Majeure Event will or may prevent Photographer from performing under this Agreement. Dewwond Mapp Photography shall have no obligation to perform under this Agreement and no liability for delays or failures to perform due to a Force Majeure Event, but Dewwond Mapp Photography may, in the Photographer’s discretion, work with the Client to find an alternative date for the event that is suitable to both Client and Photographer. To the extent the Parties cannot agree on a suitable replacement date consistent with Dewwond Mapp Photography’s availability, Dewwond Mapp Photography may also, in its sole discretion, refund fees paid to Dewwond Mapp Photography under the Agreement, less any amounts necessary to cover expenses and work (based on time spent by Dewwond Mapp Photography already performed by Dewwond Mapp Photography related to the Event, including, but not limited to, pre-wedding communications, development of timelines, and preparation of gear for the Event (the “Refund Amount”). In the case of a Force Majeure Event, Dewwond Mapp Photography shall have no additional liability to the Client with respect to this Agreement beyond that described in this Section and below.
[/icon_timeline_item][icon_timeline_item time_title="X.2"]In the case of a Force Majeure Event that impacts Dewwond Mapp Photography individually, but does not otherwise impact the Event, including, but not limited to, illness or injury to Dewwond Mapp Photography, Dewwond Mapp Photography shall make reasonable efforts to suggest a replacement photographer for the Event. Should the Client not accept a replacement photographer selected by Dewwond Mapp Photography to perform Photographer’s obligations under the Agreement, Dewwond Mapp Photography shall refund the Refund Amount and shall have no further obligation to perform under the Agreement.[/icon_timeline_item][icon_timeline_item time_title="X.3"]Client understands that Dewwond Mapp Photography works to maintain a safe work environment, including but not limited to, complying with applicable governmental laws, directives, orders, and regulations (each a “Governmental Order”). Client further understands and agrees that Dewwond Mapp Photography shall not be required to perform under this Agreement if the Event is held in violation of a Governmental Order or Dewwond Mapp Photography’s participation in the Event would violate a Governmental Order. The client also understands and agrees that Dewwond Mapp Photography is not obligated to continue to perform under this Agreement if Dewwond Mapp Photography’s personal safety or well-being has been or will be comprised or threatened at the Event, including, but not limited to, as a result of the condition of the venue for the event, or the conduct of an attendee of the Event.[/icon_timeline_item][/icon_timeline]
